€12.5K for Circuit Court Divorce only asset his pension

    I'd be very grateful if anyone could shed some light on the following:

    I'm an unemployed lone parent with two children hoping to go to college next year. In the last year I've had no choice but to pursue my ex for money to help with our circumstances. I've been back a forward to the district court several times for maintenance. On advice and to save me from having to keep going to court with my begging bowl, I'm considering going for a divorce. I could have got legal aid but the waiting list was so long and we were in dire straits. Now the rush is to get discovery, so can't hold out for legal aid. I know...if only I'd applied for it a year ago...I know...

    The only assetts between us are his pension, a civil service pension. My solicitor has given me a form to sign agreeing that once I sign it there is no turning back and that the fees will be 12.5K upwards. A friend is warning me that I could get nothing except an entitlement to some of his pension further down the line maybe. That would leave me with a piece of paper saying I'm divorced, a huge legal bill and no money for my kids education.

    Does anyone know how pensions are handled in divorce cases? Originally my solicitor spoke of a figure around 5k-6k but that was only verbal, does 12.5K sound high? Is it standard practice for a solicitor to put in a 'no turning back' clause?

    The more I try it seems the more of a mess I get into, please help if you can :confused:

    Surely he has wages (which are an asset)
    What about property?
    Access and maintenance for the kids?

    There are alot of issues to be sorted in a divorce
    Have you completed & filed your affidavits of means and welfare?

    My best friend is going through a divorce (messy divorce) at the moment and they are arguing over EVERYTHING
    his solictor has quoted him a minimum of €15,000 which includes the barrister for the hearing
    I think its high because of the volume of paperwork and phone calls and case progression hearings that are talking place because the 2 parties cannot agree on anything
