Small claims court time limit?

    Hi guys ,How long do I have in the small claims court to make a claim,is there a time limit? :confused:

    I'm pretty sure the statute of limitations act 1957 (and its amendments in 1991 and 2000) still applies to the small claims court.

    It depends on what kind of claim you're bringing. Could be as short as 2 years.

    The small claims court sounds good on paper but if your case eventually winds up in court then it will depend on the whim of the judge. I took a small claim case against a shoddy tradesperson, who accepted full liability for max allowed of 2,000 euro. The respondent paid the first installment then did not make any further payments so the matter was referred to hearing in the district court. At the court hearing respondent stood up and just said he had no money to pay and that it would take him a year to pay of the remaining debt. Even though the respondent admitted full liability the judge just struck out the case. I only found out later that the case was struck out after making several attempts to contact the local small claims registrar. So there you go, justice, Irish style.
