    Hi all,
I was in an accident in scotland last october where i was hit from behind. Luckily i didnt Hit any other car. There was 4 cars involved including my own all of which were written off. there was at least 1 person claiming personal injury, i had no innjury. I contacted my insurance company and they told me the best option was to claim from my own policy and they would claim from the person at fault. They told be the claim would definately be sorted by the time my renewal was due. My insurance is up today and its still not settled. I cannot afford to pay 1500 for insurance. with my no claims it should have been around 750-800 which i would have managed.
I have been given assurances this would be sorted by now and because of this bad advice i cannot afford to insure my car.
Is there anything i can do?

Are you changing insurance companies? why would they pump it up if it is still an unresolved claim? also you should get no claims insurance. Costs very little and gives you piece of mind!!

I have step back protection but its not much good as i stepped back from 4 to 1 year. The renewal is up because i claimed from my own policy but they have not yet recovered my claim from the other side :( and im not changing companies....... yet

so you need insurance but cant afford 1500. why not pay the insurance monthly then. It will be a deposit of about €300.
Ring the company and talk to a manager and explain the situation.

in a similar boat with regards to the NCB part, car was stolen in Jan, renewal was due in Feb, lost 2 years and 11 months so went from 4 eyars to 1 year and i never done anything wrong. still fuming over it.

Have you tried discussing this with your ins co? A similar thing happened to me a couple of years back and my NCB was unaffected because, although my ins co had not yet recovered the money, liability was not an issue.

They increase the renewal premium if there is a claim made against the policy, which is the case here.

I feel some sympathy for the op here. Their ncb has been reduced because of the insurers inability to get a no fault claim settled on time.

I'd ring them, tell them exactly what you've said here op, including the bit about being advised to claim from your own policy (even though that'd be difficult to prove) and threaten to go to the insurance ombudsman if the don't reinstate your bonus in full.

But you still made a claim for theft. That's a claim and the NCB has to reduce as a consequence. This is completely different to the situation with the OP where another policy will carry the cost. In your case your policy must carry the cost.

He shouldn't have taken the kind advice of the insurance company. He should have went straight for the person at fault and claimed on their policy.

    Hindsight for the OP!

Rang them and they say it will be at least 7 days until they might have it resolved. They said they cannot reinstate my no claims so until its sorted im not driving. Also made a formal complainnt but not sure that will get me anywhere. Is there any cause for damages here for the poor advice they gave me and for the fact i will be without transport for god knows how long

Can you prove that they gave you poor advice rather than advice on all options and you made an informed decision?

The accident happened in scotland so i could not even get insurance details as cars there do not have to display their insurance, and the lassie at fault was rushed to hospital from the scene. Also the police wouldn give me any insurance info and said my own insurance company had to persue the claim.

In hindsight i should not have claimed i only recieved 4500 for my car but i needed the money then.

I have no proof but i thought they recorded all conversations? i couldn prove it without recording the conversations myself, is it not up to them to prove they didnt tell me it would be sorted before my renewal and to prove they did give me all options?

    You are being very naive.

You are entitled to a copy of the calls under the Data Protection Act.

You were entitled to the other drivers insurance details. The police have to give them to you so you can claim. They just fobbed you off. Typical of the UK police these days.

Firstly, I bet that call recording has mysteriously corrupted or something.
Secondly, if you are claiming that they provided bad advice, the onus is on you to prove it. Our legal system applies innocence until proven guilty (excluding speeding offences of course)
