Part VIII processes, how do they work?

    I live in an estate not yet taken in charge, the local authority are in the act of taking over the road through the estate to form a link road joining two regional roads. They are doing this under what is called a part viii process, the consultation and public display period has passed, and 190 submissions have being lodged with the local authority opposing the road. The local authority are relying on a local area plan drawn up in 2002 as being the blueprint for this link, however on other issues within the 2002 LAP the councillors have argued that the plan is outdated and needs to be updated.

    We are aware that we have no appeals mechanism with An Bord Pleanalla, but what happens next? Are the local authority judge and jury on their own plans! Anyone any experience of this or know of where this type of thing was succesfully stopped previously.

    The estate is about 10/11 years old and as you can imagine is full of young children which is not conducive to a link road with a speed limit of 50 KPH.

    Any advice is welcome!
