    There's some road works on the road outside for the last few weeks, the ESB digging up the road and with this, they've dug up through the pay and display parking areas and in doing so, have had to dig away the surrounding markings in places. They've filled parts of the road back in where there is now still parts of the markings, as well as the sign at the side of the road, but in sections, there's no markings and I've just seen two cars ticketed in such sections (no not me!).

    I've seen on a UK "f**k the system" type website that there's an array of ways to get out of having to pay fines and I seem to remember that if the markings aren't clearly visible and painted the whole way around a pay and display area, then a fine couldn't be imposed. I also remember when the heavy snow was here over the winter that it was easier for a van to park over the snow than having to go up the lane way and stay overnight there so I rang the DCC parking section and they said as long as the snow stays there, covering the markings, then they can't clamp the van.

    Does anyone know the legality of such a situation with the markings so and not just hear say? Be interesting to find out and maybe print out a link to any evidence and stick it on the ticketed cars :D

    Don't know the status but I think the ESB, as the persons who've created the issue, should pay all parking charges and fines until such time as they have put the road back in as good, or better, condition than they found it. Same goes for anyone digging up public roads.

    Hmm, but it could be argued that there shouldn't be any fines if the road has been dug up thus making the markings disappear, if of course the markings make a difference under Irish law?
