Where do you stand after assault?

    Hello Guys,
    I hope you can open my mind a bit......

    Last Friday my brother was out with his friend in our local town.
    On his way home with his friend, a car pulled up beside them called him over and started talking rubbish.... Then the guy in the passenger brings up that my brother does Judo, asks him "do you think you could take me on?" ( i know .. same alpha male Bull**** ) ... He then proceed to get out of the with a hurl.. (gaa hurley) and asked again..! My brother then turned around to walk away..... as he did he was hit with the hurl at the back of his head. Since then he is still in hospital with minor bleeding in his brain.. The guards have the guy.. I just want to know where my brother stands... he has been in hospital since Friday. will miss his exams and has 15 stitches. My brother has not eaten nor slept since sunday. He may still have to go to beaumont hospital to get his head fixed....

    So my question really is where does my brother stand and will the guy go to jail for what he did and for how long?

    well as of now he is in hospital 5 days and i dont know how much they charge... but does this payment lie on us??

    Also should we sue?

    Take him to court. I was assaulted a few years back. I was outside a chippers. A taxi was coming down the street and stopped beside me, a guy jumped out and punched me in the face knocking me to the path. When i came round the guards had me lying up against a car asking was I ok and what happened. It just happened so quick I didn't know. Luckily the guards were just coming down the town and as the guy jumped into the taxi they followed it down the road and pulled it over. He was charged with assault and i was compensated for my injuries. After all that it turned out to be a case of mistaken identity. He didn't know me at all.

    Check to see if there are CCTV cameras in operation where the incident occured. He'll have to pay for his medical expenses but if he brings the case to court he will get it back and possibly wages he has lost due to being unable to work.

    Speak to a solicitor. Anyone who gives you any advice other than that is not worth listening to. The criminal matter will be dealt with by the Gardai. If there is a civil issue then that's a matter for you and your legal representatives.

    I hope your brother recovers well.

    Re hospital charges - depends on his insurance etc.

    Re civil claim - if you know who he is, take legal advice from a solicitor; it may come down to whether the bollox has any means of satisfying a judgment against him.

    Re criminal proceedings/whether he goes to jail - obviously co-operate with investigating gardai, provide statements and be willing to give evidence. Whether he goes to jail or not is up to the presiding judge, if he is charged and convicted or pleads guilty - impossible to predict without knowing more about him and the specific case and even then impossible to predict on the internet. .
