Proposed Thru Road - How do you stop it?

    I live in a private estate, not yet taken in charge by the local authority, however the local authority have started a part 8 process to incorporate the road through the estate into a proposed link road joining two regional roads with a 50 kph speed limited.

    Any suggestions or legal tips on how to stop this from going ahead, the submission deadline has passed and there have been a significant number of objections lodged.

    I'd be very surprised if the council made your estate into a short-cut between regional roads.
    Did you see the full plans?
    I'd check to see if they are going to put up bollards in the middle of your estate to block the path of any rat-runners

    Yes, I viewed the plans and thats the situation, they are opening up a school that needs access on one of the regional roads and this is the cheapest and easiest option, they are extending our road by 280 meters across council land to link with the second regional road!

    Calling a spade a spade, children will be injured or worse if this goes ahead.

    If your overall objection isn't accepted you should look for conditions. Crossings, speed bumps and a weight limit to name but a few.

    The road goes past the estates, not through them. Make sure there are adequate boundaries.
    Any suggestions on how to stop this from going ahead, the submission deadline has passed and there have been a significant number of objections lodged.
    If you haven't made a submission, then you would need to support someone else's submission and lobby your councillors.

    When you turn off the R415 on to the proposed link road both sides of the road are the same estate, 50 houses to the right, 30 houses to the left! 190 submissions lodged with KCC including one which is based on legal advice, you can see that one on the website www.rathbrideabbey.com

    Anybody know what adequate boundaries are in meters and centimeters?

    Consult an engineer experienced in road design and planning.

    Liase with an objector who has filed in time so that enngineer's report can be used in any hearing.

    Check the conditions in the estate's planning permissions to see if there is any specific condition about the status of the estate roads.

    If a Part V111 application is involved lobby your councillors.

    Thanks for the advice NUAC, if anyone has anything of a technical or legal nature I would love to hear from you because this decision will not even be appealable to An Bord Pleanalla!
