Is it legal to sell replica Clothing Items

    Hi All,

    Advice appreciated please. I was thinking about setting up an online store to sell replica clothing items, which can be sourced fairly cheaply from Asia. I would love to know about the legalities of this. I would be upfront and inform the users that the kits are replica items, but I'm not sure if this is legal or not.

    It's illegal. Producers have protection of their designs with copy right and trademarks. For example there was a land mark case where Karen Millen sued Dunnes and now retailers can use this as precedent law to hammer anyone before they get started.

    It's best to build a name for yourself and not piggy back from others hard work.

    What level of replica are we talking about? You say kits so I'll assume you mean football; red t-shirt with the word "liverpool" emblazoned across it and white stripes down the side: legal, red t-shirt with replica standard chartered and Barclays logos and liverpool crest: Illegal. Go into a souvenir shop and take a look at the Irish jersey style t-shirts, this is the extent of legal (example).
