    Hi, not sure where to post this so mods feel free to move! Okay so I work in a chemist, my manager has been lokking back on the shop cameras and using it against us,telling us so and so was talkin to somebody for a few mins etc. Someone was checking their phone and so on...my question is can she do this?! I'm under the thought that she can't use it to do this I know somebody mentioned this before that the cameras are there for security reasons not to catch staff out...is there any set rules on this I can find on the web? Because if she cannot do this I'm going to give her proof she can't. If I'm wrong and she can fair enough just need to know.thanks

    No she cannot. It is a breach of the Data Protection Acts. The cameras are only there for security and not for staff monitoring. Report it to the Data Protection Commissioner.

    Your employer has to tell you that the CCTV is monitoring both you for performance review purposes and the security of the shop.

    Any member of staff would presume rightly that the cameras are there for security. Using them for reviewing your performance is a different matter and almost unheard of.

    Your employer seems to be using CCTV in a trivial manner while the Data Protection rules require a serious reason for staff to be under surveillance. A good reason would be security of tills but this would only require the person using the till to be recorded.

    Check your contract of employment - your boss may be in hot water. I would also suggest contacting the Data Commissioner.
