Are SKY correct

    This is a issue my mother has

    August last year i upgraded to to SKY HD and gave my mother my old sky+ box

    So she could record stuff.It only had one wire/feed going into it so the box did not have the record another channel.
    It would only record channel that was on

    Anyway she rang sky to get her card she already had for years to work in her sky+.

    Sky paired her card to the sky box i gave her


    She phones to cancel today

    Lady informed her because she paired her card to a different box it ties her into a new 12 month contract.

    She is fuming as i gave her the box not sky.I switched over her box for mine.So SKY done nothing only pair the card my old sky box

    We did got onto 2 different people both said the system won't allow a cancellation.
    They said to write to them :rolleyes:

    As u supplied ur own box I reckon they are wrong..but as always Sky hold every1 over a barrel

    I suppose it's possible that a boxswap would be considered a new contract, but I think it's unlikely.

    I'd still try another phonecall looking to speak to a supervisor.

    Failing that, write to them and ask for a copy of the recording of the telephone conversation where the contract was formed or a copy of the signed form that commenced the contract.

    As much as Ireland, the UK has the Distance Selling Regulations which says there has to be a copy of your contract kept in a durable form. This means either a telephone recording or a signed contract.

    If they can't produce one or the other of these, then there is no new contract.

    If they produce a recording, it'll be really clear if she signed up to the service or not. They have to specifically mention the new contract - i.e. there is no verbal equivalent of 'small print' allowed. (for example not telling the consumer that the boxswitch would lead to a new contract)

    Give them a date to reply to you by in the letter, two or three weeks is normal. If, a week after this date passes, you don't have a response (or if you don't get a satisfactory response) get in contact with the ECC Dublin who should be able to help you further.

    A bit off topic but how can a new contract come into play if one party hasn't signed anything, I know it happens but is it legal without any paperwork or are they all just taking a chance.

    I'm pretty sure it can as long as the customer is made aware that he is in effect going into a new contract. Happens with mobile operators all the time. They offer you a better deal, you go for it, they inform you that this ties you with them for another 12 months

    Sky are wrong, just ring back until you get someone who will play ball with you.
    I've often had to ring 3 or 4 times just to get a card paired or activated, some of the ****e they come out with is unbelievable.

    No doubt this "Lady" was working in the Cork Abtran call centre.
    That crowd are the most incompetent bunch of cabbages I ever encountered .

    basically you paired a viewing card to a new box but at the same time sky added the sky+ subscription to your mothers a/c this has to remain in place for 12 month which is read out in a mandatory statement during your call
