I posted this in legal, but thought it might be apt here.

I was clocked speeding on the N7 in the wifes car on 17/02/11, 115 in a 100 zone, i've no issue paying the fine and taking the points but the ticket only arrived today but has a date of 01/03/11 on the fixed penalty. Called the number to be told i have 10 says to pay 120EUR and the points are already on the wifes licence (she wasnt driving) Is there anything i can do bar going to court?

The cops have up to 6 months to inform you of an offence I think.

    You've read it wrong dude.

OP if you don't pay it by the due date you will receive a summons to go to court, if this happens and you explain your case to the Judge you are at his or her mercy, if convicted of speeding in court the penalty is 4 points and a fine

The dates by which you have to pay should be from the date of the issue rather than the offence.

OP are you sure you just didn't "misplace" the ticket. Then when the 28 days were up and knowing your good wife would get the points and not you, you sliped the ticket into that days mail. Wife opens it get a bit angry, you also fain anger and dimay and say "it's ok love, I'll ring the helpline number and sort it out, this is disgraceful!!".

After the call you inform her that there is nothing you can do, she has got the points but say you'll pay the €120 and try to sort it out. You reasured her that the guys on Boards will have the answers..........

    Well played sir, well played!

Still, I jest. The Gardai should realy send tickets via registed post. Less time wasting court time and expense.

They would probably run a busy station for a month on what they would have to spend on registered post though

Isn't it €6 to send something by registered post?

Could boil down to the judge on the day I think. The letter doesn't have a date stamp apart from a series of orange ticks on the back, any idea what they are for?

They could include it/add the cost of the registered post to Fine.

Not to mention the savings on Gardai and court time not been wasted.

then they'd make only €74 profit

would make too much sense to happen

Gut feeling is that you should pay the €120 to avoid any escalation on that front, then explore how to go about having the points moved from your wife's licence to yours.

You probably won't have much luck trying to claim that something took 45 days to arrive in the post. Is it possible that it was delivered to the wrong house and the person only got around to dropping it into you today?

I think this is the most pain free method, anyone know how to get points transferred?

    Apparently it can't be done.

I had same issue a couple of weeks back. Wife cought speeding by camera van sorry, Safety Van in a car where I was the first name on the registration.
    Mr Twin-go
    Mrs Twin-go
    Our Address
    Our Town

She was passed the 28 days and went to pay the €120 fine. Filled out her details so they put the points on the correct liecence. A week or so later letter came in saying you cannot nominate a driver after the 28 day period. I rang and explained the situation but no good. The system is automatic and cannot be changed. They gave me 2 options: 1. Pay the fine and first name on register gets the points, 2. Wait for the summons and see what the Judge will do.

I took the hit. the 2 of us would have to take the day off work and I could have got 4 points.
