Turbary rights

    Land Commission gave turf cutting rights on my land in 50s. Most of the original owners of the turf rights are now dead. Can someone else claim these rights or do I own the land and the turf again?

    You obviously got compensated for these turbury rights (Financially or with additional land) and a written agreement was drawn up. We can all speculate what was written in this agreement and in other agreements that we may have in our posession but the only way for you to find out where you stand is to get a copy of your agreement - It will clearly state where you stand.

    I think that you will be able to access these documents through your local department of agriculture office (if not they will be able to point you in the right direction).

    I'm sorry that I can't be clearer. Close to me, turbury rights distributed on one bog is attached to land. If I bought a certain farm, i would have turbury rights in a certain section of the farm.

    On another bog, its attached to people - if they die, their turbury rights go.

    Its all to do with the wording of the agreement.

    There was no Compensation to the farmer at that time. Turbary rights were owned by the landlord and the Land Commission purchased them from the landlord and distributed to local households.
    \The turf rights seem to be attached to a dwelling, according to local knowledge.
    I cannot find any references on the web.

    Sorry, by you, i meant the owner who at the time was obviously the landlord.

    back to your original post - the LC gave turbary rights on the land that you now own. Surely when you bought/inherited the land the terms of these turbury rights are in the deeds??

    Turbary rights are extremely complicated, mostly because a proper agreement was not drawn up when they were issued.

    You can get a copy of the agreement from the Records branch of the LR in Portlaoise. You'll need to send in a letter with the request and also your folio numbers etc. There is a small charge.
