Car with no tax; not parked on road.

    Hi all, I'm just wondering what would happen in this case: I have a car that is parked across the road from my house(in a car park type place). The car is not parked on a road. Its been there for about 1 year. Just got a note posted through my door from one of my lovely neighbours saying that if I don't move it they are going to ring the council and I will have to pay the costs. Is this true?
    The estate I live in is a private one. The car spaces are for anyone who wishes to park there.

    well i agree with the neighbours..if i had to look outside and see a ****ty car that wont move id be pissed off too even ifs not causing a obstruction..better to scrap it i think mate

    yeah I would but can't afford to pay someone to take it away. If its the neighbour I think it is they can't even see the car from their house. They are just serious busybodies who seem to have a grudge against me for some reason. There has been many mornings when I have left my house to see a note on my car from them: this is my space etc...... when it clearly isn't but thats a different story anyway. The car is not in bits either, just I don't drive it. I can't find any info on how much it was cost me if the council take it away so any info on that would be great. I know they can take away a car if its parked on the road with no tax but mine is'nt.

    Its a 97 VW Polo, if anyone wants it they are free to take it. As stated it hasn't been driven or started in over a year so don't know it that would throw up any complications.

    Take the insurance and tax disc out and drive it up to some ****-hole. Roll the windows down put the radio on and leave the keys in it. The knackbags will think all their christmas' came at once!

    Or just leave it open where it is with a sign in the back window 'free to take away' and leave the keys in it.

    If its a private estate is their a management company. They would normally tell a person to remove a car with no valid tax or insurance

    Motor tax has to be only paid for vehicles used on public road.

    1.—(1) On and after the 1st day of January, 1953, there shall, subject to the provisions of this Act, be charged, levied and paid in respect of mechanically propelled vehicles used on public roads duties of excise at the rates specified in the Schedule to this Act.

    So if it's parked in private estate, there's no need for motor tax.

    The funny thing is, that if you would like to tax it again, you have to sign a declaration, that "you didn't use vehicle in a public place".
    And estate most likely is a public place.

    That makes the declaration required by motor tax office, be in contradiction to the Law.

    I never thought about it tbh, the car is not causing any trouble for anyone; and I don't give it much thought either. Just one of those things I never got around to. Someone on Boards may be taking it off my hands anyway, thanks for replies and help.

    Don't know why you are upset at the neighbour.

    You have effectively abandoned and dumped your car in the estate for a year now.

    Take some responsibility and clean up your mess.

    Parking =/= using. Even if it was on a public road, it wouldn't be illagal under tax law. It would probably come under dumping, instead ;)

    OP I can't believe you need the help of an internet forum to tell you that your neighbour(s) are not being unreasonable at all, and that the course of action you should follow is to sell, remove or give away the car.

    How am I being unreasonable here? I own the house and I personally don't think its up to my neighbour to tell what can and can't be parked there. There could be a number of reasons why I am not driving the car for all they know; can't afford insurance etc so I think they are the ones being unreasonable when it is causing them absolutely no trouble whatsoever. The car is not a piece of junk. Visibly its looks fine. I am just not driving it.

    I'd seriously look into putting something else in it's place. A large planter or something. Parking spaces are still making money around Dublin. Know a woman who was offered €100/month for hers.

    Council wont touch it as its not on a public road. They are just trying to scare you into doing something about it.

    I don't think the OP is being unreasonable at all. If he/she is entitled to park there then they're entitled to park there. As long as it's not causing an obstruction or hazard of some type, I don't see why it's anyone else's business if it moves a few times a week or not.

    is there/was there any possibility you would use the car again. Or was it purely you didnt know how to dispose of? I think you are totally entitled to park there... unless you are using another car too then I would see it as you have dumped it. Dont think your neighbour has any say in the matter.

    Lol once my landlord came and said to my bf he needed to get a car removed from our premisis. It was a 93 micra and looked rough but worked fine. A neighbour gave it to us when our own car was totaled. We lived rural so it was great to at least be able to get to shops. Haha my bf was not impressed and told her thats his work car. There was no way he would drive it to work. We simply used it to get to the shop until we got our new car. :P We got it scrapped and collected for free once we didnt need it.

    Ever see those ads "need cars, cars for cash" its often a scrap yard.

    Tax it, park it as (legitimately) close to their house as you can. Then undertake a skangerisation project of epic proportions, as cheaply and as tacky as possible. Or rat look

    Try a recovery company and ring scrap yards they'll know who will take it away for scrap value aka free in your area.

    The council charge some others don't.

    If it is definately parked on private property then you do not need tax/insurance.

    However sometimes a an old car parked outside a house and not being used can attract "undesirables". People knocking on your door asking is it for sale etc. Which might be unpleasant or intimadating if they are knocking on your neighbours door thinking it is their car.
    I had an old car parked outside my parents house that I didn't use much and they got people knocking on the door regularly enquiring about so I felt it only fair to get rid of it.

    Also if you're unnecessarily using a parking space that someone else would like it may not be considered very neighbourly.
    Should be easy enough to get rid of without any cost to you.

    The best thing for you to do (for your poor neighbour sake) is to swap the car for a BIG caravan with lots of chrome on it, and if a transit van came with it all the better, it would be good to see there face then !

    Ring the council and ask them about it. If they say all is ok, then leave it and get rid of it in your own time.
