    Hi,

I bought 2 items from same seller on ebay on the 1st of march. Today is the 8th of april and still noting. I have contacted him a good few times and no help at all. Says im going to stop over sea sales ect...
I asked for dc number or who is the company going to deliver my item.. i want to be able to track it to see if irish customs has it. But he has yet to get back to me.

Any way i used ebay dispute resolution center today. As im fed up off it all now. I don't think my problem will be resolved and i don't think i will be getting my items. So how long should i wait before i go and look for my money back via ebay/paypal ? as in bring the case to the next stage.

Talking 200euors so i hope i get my money back :(. Just wondering if im doing it the correct way.
Even if i got my money back and some magic happens and my items turn up in a months time i would have no problem in sending them on their money again.

    Thanks

Open a dispute in Paypal. If its in the post and it arrives you can close the dispute. If it doesn't arrive then hopefully you will be covered by Paypal. Usually you will be. I would have opened a paypal dispute after 2 weeks. Paypal disputes can only be opened for 45 days I think after purchase so get on it.

They usually always favor the buyer in my experience.

    Thanks,

I went to try and do that "Our records indicate that you opened this dispute within the last three days"

So i will wait till monday and then do it again. Have to give seller time to get back to me ect....

Still will be under the 45 days by then. Think it will be 42 so i should fingers crossed be ok.

But it also says can take 30days to process ahhh

Check sellers feedback and see has he any items on sale at the moment .

He may be gone to ground and left other buyers high and dry too .

If seller cannot provide a tracking number , he won't have a leg to stand on .

If you opened a dispute through eBay , this is probably linked to Paypal and dispute is recorded there too.

Go to Paypal resolution centre and see if you have any open items .

    Hi,

Yes i did it through ebay. and it brings me to an open case in my paypal account. He does not have any items for sale... so like u said he might be gone if so i say im kind of stun.

Anyway i went to the next step in paypal and escalated the dispute.

Not sure if i did it right and i did not wait the 3 days but felt i waited long enough.

You will be ok , like, you probably will not receive items at this stage , but at least you should get your money back.

Seller will be given an opportunity to prove item has been delivered to your address , and if he is unable to do this , you should win.

Paypal usually settle disputes like this , within 3/5 working days

Did that twice before got my money back both times with paypal no worries. The last time the goods finally arrived about 60 days later. both were hong kong sellers.

The 45 day limit is just for opening the dispute. Since you have now done this, you can take your time in escalating to a claim. Don't take too long though, as a dispute automatically closes in 10 days if you take no action at all. Wait the required 3 days, then escalate to a claim.

Whatever you do, do not close the claim or dispute until you receive a refund or your goods. Some sellers will promise a refund if you close the dispute, but this is most often a means to scam you out of your refund. Once a dispute is closed, it cannot be reopened and you cannot open a new dispute for the same payment. The seller will be under no obligation to refund your money, and you'll be left swinging.

    Thanks for all the help.
Well i escalated the it and did not wait the 3days.
But like u said i wont want to close it as i wont be able to reopen it, did not know that so thanks for the heads up.

Going to leave it as it is. And see what happens.

Hi Bad Charlie.looks like I'm heading in same direction as you with a UK seller.
In fairness to him he is staying in contact with me but he is basically saying its up to me to chase it up.
Its a cd player which was posted through royal mail on 19 march.
He has emailed me with tracking number which does not yield any info at al.
This is part of his email.

''The post office did inform me that it could take a while, and once out of the UK I won't be able to track it further.
I have still kept the receipt, so if still no sign of it in the next week or so, I can send or email the receipt so that you can make a claim at your end.
I have already checked with Royal Mail and they have advised that it has to be the recipient (receiver), who has to apply for the claim if not received.''

How did your dispute finish up?

Open a case with paypal its the only way. the onus is on him to check things out. If he cant provide you with a tracking number he is liable. If you did not recieve the item its not your fault and paypal usually refund you under these circumstances

If yo ucant get a resolution after opening a case do a chargeback (if its a visa)

All lies, he's fobbing you off in the hope you will just go away. Start the Paypal dispute for item not received now, as it is the sellers responsibility to make sure you receive it. You cannot claim at this end, as it's Royal Mail's job to reimburse the sender in a case of an insured item going missing. No claim can be made by the recipient with An Post.

I was just in middle of opening dispute and decided to give him one last chance, so I emailed him and told him post office could not help me and he needed to find out where it was. Now in fairness to him he mailed me back almost straight away.

'Will do, but did they say why they couldn't help?
Just wondering because when i last enquirer about it, they said because I had sent the parcel and had proof of posting, it would be the recipient that would have to file the claim if it hadn't arrived.
I'll speak to them this end when I can, and get back to you.
Just a thought.... Could it be held up at Customs?'

Could it be in customs? How would I check?

    Latest reply:

''They( Royal Mail) have said to allow 25 working days (excluding weekends) for delivery to European destinations.
Once left the U.K. It cannot be tracked.
25 days takes it to Friday 22nd April.
If it hasn't arrived by then, I can put in a claim with Royal Mail.
Obviously if still no sign by the 22nd, just give me a shout and I'll log the claim for you.''

if its coming from the UK it is not stuck in customs. File a claim NOW.

He would not be logging a claim for you, he would be logging it for himself. You will be getting refunded through paypal.

    Hi Dearg Doom

My issue is still on going. Still waiting on seller to make any contact. Also it says in paypal he has until the 18th to respond.

So this issue is going to be around for some time yet.

That's a fob off. He needs to claim from Royal Mail, and if they need him to wait until the end of April to do that then that's not your problem. It won't be in customs anyway.

Your claim needs to go through Paypal now, you cannot wait that long as Paypal will not let you open a dispute after 45 days.

The seller is given 10 days to respond to a claim. If they fail to respond then the claim is automatically settled in your favour.

    Hi BadCharlie,

Have bought lots of stuff on ebay over the years, but this has to be longest I've ever had to wait for anything.

Hope it works out for you (and me!)

Happy to hear you recieved your stuff today.
BTW where were they sent from?

  • Registered Users, Registered Users 2 Posts: 2,614 ✭✭✭BadCharlie

I bought it from a guy in USA.
But on the box it had a return address in sweden.
I have bought a good few things from the usa before and normally it only takes 10working days.

It could be drop--shipping ......The buyer may be in the USA , and actual item warehouse in Sweden , or maybe the other way around.

On eBay , a seller can change his location to anywhere worldwide , afaik .

So it could be that either .
