    Hi,

    Does the employer have the choice as to whether it;

    Pays the employee whilst the employee is on maternity leave and the company takes the DSW payment

    or

    Doesn't pay the employee, the employee gets the DSW payment and the company pays back pay (less DSW payments) when the employee returns to work?

    It should be in your work contract as to whether your employer pays you while on maternity leave. Employers are not obliged to pay you while on maternity leave.

    If they are being nice enough to pay you for maternity leave then they would normally have how the DSW payment is worked out in their employment handbook.

    Normally either your social welfare payment is made directly to your employer and they pay you or you get the social welfare payment every week and your employer pays you the balance.
