    How long do I need to live in ie to pass this part? Is it 2 years, 1 year or ...?

    Not necessarily, everyone's case is decided on its own merits. But the longer you are in Ireland, the more likely you would be to satisfy it.

    Habitual Residency used to be automatically granted after two years however, that changed some time back and it is now decided by the applicants 'centre of interest'. This is a call made by the Deciding Officer processing your claim and can be appealed.

    In my experience they turn most down, as the one thing they know is that you are applying for some sort of welfare payment and that is what they take to be your centre of interest. It would appear that they then wait to see if you appeal,what kind of appeal you mount and its merits.

    What is not apparent to most is that, even Irish citizens borne and bred, who go out of the Country for any period of time (Year/2 years) say to Oz, Canada, anywhere in fact, will all face this when they return to our shores before they can access any welfare services!!

    Sorry you had problems but you get good and bad in every area, you got bad followed by good!! Most of us don't check our feelings and prejudices at the door when we go to do our days work and it is the process (long as it maybe) that ensures fairness!! Imagine if the first official you met was the only one!!!

    Glad you are sorted...my rules for dealing with social welfare:-

    1. Keep copies of everything. Applications, additional info etc

    2. Birth Certs and other official document can be added to a claim...get the claim in and add documents to it asap (Ref with PPS No)

    3. Do not give them original documents, ask them to copy and return originals. If posting send copies stating the originals are available for scrutiny.

    4. Posting something to them...recorded delivery..the only way.
    5. Get a name, a full name and a telephone extension
    6. Keep all correspondance from them.

    My rules for dealing with these matters!!

    this is very good advice. i find eastern Europeans particularly those from formerly behind the iron curtain countries do this almost instinctively and have different, pristinely kept, folders for tax, SW HSE etc. it makes everything alot easier when problems arise.

    8 and a half years dealing with this amongst many Gov Dept's has taught me that you can rarely do anything about errors made on their part but if you are organised, you can cut down on beauracratic error :D
