Criminal Damage / Assault?

    Hypothetical.

    5 lads set on another (who is a complete stranger who has never seen any of these people before in his life) outside a nightclub. The group of 5 are sober and the other guy is clearly not. The guy on the sauce climbs into a taxi. Two of the 5 aggressors kick the door of the taxi (causing a sizeable dent) as the driver has locked the doors.
    Taxi driver calls over 2 gardai who didn't see what went on.

    Possible sentencing on conviction, if it goes that far? Let's assume the 5 lads have never been in trouble before.
    I'm guessing at most it would be fines and a caution but not sure.

    If they've never been in trouble they might only get an adult caution. But it all depends on what they are charged with. They could be done for Violent Disorder, Threatening and Abusive Behaviour, Assault, Criminal Damage, Breach of the Peace.

    There are a few variables. Has compensation been paid or offered? Have the victim or the taxi driver given statements saying they were put in fear. Is there a guilty plea? Was any one injured? Depending on the way the defence is handled it could go from poor box up to a six month custodial sentence.

    No statements were taken off anyone in the taxi (bar the driver) which includes the guy assaulted.
    No compensation offered.
    Let's say they deny everything.
    No injuries, the guy they were after got his feathers ruffled a little but that's it.
