    Just noticed a huge increase of threads about robberies etc and I would like to know. How many Boardsies would have the balls to make a citizens arrest rather than posting about it here?

    Personally if I seen something against the law happening around where I live I would, if failing to get the guards up in time was an issue

    You really need to know the law to make a lawful citizen's arrest. If you don't know how, when and how to arrest someone and what to say, you could leave yourself wide open to civil and possibly criminal charges.

    There are two situations where a citizen's arrest without warrant may be lawful: the arrestee has committed or is committing an indictable offence, or the arrestee is `unlawfully at large'. Private citizens may also have the power to execute an arrest warrant in certain circumstances. These will each be considered in turn.

    I understand that a Citizens Arrest is only lawful where a felony has been committed.

    PSNI you might shine light on this maybe.

    Considering that a lot of these robbers are drug addicts who are feeding their habit; I wouldn't attempt it because the screwdriver in their hand could end up in the side of your head.

    There's far too many legal loopholes and far too many dangerous outcomes. You are much safer just posting it here and leaving it to the people who are trained and paid to do it.

    I'd rather see a thread about it here than on the news when somebody is murdered for trying to stop the robbery.

    You would be better off taking a photo of the person breaking the law, most people have a camera handy now, be it on a phone or a digital camera. Ideally we would all like to claim that we would make a citizens arrest but in reality its just not that simple.

    But whats the point, the law has gotten so leiniant these days. people who get caught robbing now doesnt go to prision for a couple of years cause the jails are so full, and if they dont get caught doing anything within the 2 years the get pretty much off for good behaviour. was robbed last year, guy was caught and he was out the next day laughing at me.

    Felony has not been part of Irish law since 1997. There are arrestable offences i.e. offences which carry a sentence of 5 or more years of imprisonment. Since most members of the public would not know what offence might have been committed and even if they did, would not know the sentence for it, non Garda arrests should be avoided where possible.
