    Under law must an employer pay you for maternity leave or can an employer bring in a rule to say they dont pay maternity leave ?

    They don't have to pay it; some companies do top up payments but it is not required by law.

    unless it states so in your T&C of employment your employer is not obliged to pay you anything while you are on maternity leave. if it was in your T&C and it is now changed then you could go to the rights commisioner with your compaint.

    You will be paid by the social welfare so long as you were employed under PAYE conditions for (I think) 2 years. You will recieve an amount that is a percentage of your current wages up to a maximum amount but never below a set minimum.

    Just to add the maximum maternity benefit you can be paid is currently €162 per week.

    Wmpdd3, think you are mistaken, or it is a typo. Current rates, are as follows:

    Rates of payment from January 2011:
    Maternity Benefit Weekly rate Maximum payment €262 Minimum payment €217.80(from CIC)

    You will recieve an amount that is a percentage of your current wages up to a maximum amount but never below a set minimum.

    It may have been changed in recent times but previously it was not a percentage of your current wages, but rather a percentage of your average weekly wage in the relevant taxt year which, if you were going on ML this year, would be 2009.

    OP, the employer doesn't have to bring in a rule to say the don't pay maternity leave, it can usually be presumed that they do not unless your contract states otherwise.
