    hi guys,

    im doing a trademark essay and stuck on a small question,was wondering if anyone could help.

    can a trade mark be acquired in the distinctive pattern of a 'bicycle tyre' ??

    Theoretically, yes. But I imagine it would be difficult enough. The pattern would have to be very distinctive, so much so that it could distinguish your product from others. The trademark is a sign or logo that can be graphically represented to distinguish the product/service of one undertaking from another undertaking and I would have thought that this particular pattern would have to be used elsewhere and not just on the tyres, i.e. on the packaging.

    I would have thought that a patent would be more suitable to a particular tyre tread/pattern, presuming that the pattern confers some sort of advantage on the user.
