Drink Driving

    If you are drink driving and involved in a single car crash where some of the passengers were hospitalized, can the Garda do you for anything else other than drink driving, driving with a provisional and no fully qualified driver? The people that were in the car do not want to take it any further. I thought myself that the Garda could add charges like reckless endangerment.

    It depends on how you were driving and how over the limit you were as well as wether you caused the crash. You may be done for careless driving and driving unaccompanied. Often what happens is that these lesser charges will be dropped if a plea is agreed before hand with the prosecution. You should get a solicitor with experience in the court you are going to.

    Count your lucky stars they CURRENTLY don't want to take it further. They have two years from the date of the accident

    get legal advise ASAP .. don't be listening to FACTS from randomers on the internet or drinking buddies down the pub (when they get out of hospital that is) ....

    Your mates do not have to make a complaint for you to be prosecuted for causing their injuries .. just like a dead body can't make a complaint when someone drink drives causing death ...

    the only advise I would give is to get a good pair of walking boots you will need them ..... that is if the judge doesn't decide to give you a few months B&B.

    Oh .. and get a second job, save as much as you can so when you get your license back in a few years you'll be able to afford insurance.

    When the OP said his/her friends wish to take it no further is that with the cops or regarding compo.

    They have 3 years to decide on the compo BTW.

    Whippet got there before me. AFAIK it is irrelevant on whether or not the passengers want to prosecute. Bottom line is you have broken the law(exactly how many laws is up to the Garda to decide) so what exactly happens depends on what the Guards take of the crash is. Definitely get a second job, you'll gonna be in for a MASSIVE shock whenever you next try to insure a car!
