Question re: Part 4 Tenancy

    If after six months as a tenant in a shared house, where in the absence of written contract or lease,you have a part 4 tenancy, can a landlord still demand you pay the extra rent for a room that remains unlet despite all efforts to find a replacement tenant?

    Also, can a landlord threaten you with eviction for not signing a new lease because you refused to pay rent for the extra room despite best efforts to find a new tenant?

    My understanding is that you rent the entire property, not per room (unless otherwise stated in a previous lease). If you have one less house mate than when you moved in, that's your problem not the landlord's.

    I'm open to correction on that, but I'd be pretty sure it's correct.

    If you are only renting a room you are not a part 4 tenant. You do not come under the RTA 2004 at all. The landlord can throw you out for any reason or none. If you are renting the entire dwelling you are jointly and severally liable for the rent of the entire with the other occupants.
    You can't have it both ways.
