advice needed re _ unhelpfull doctors

    unusual situation here , i was wondering whether thier is anything one can do when faced with doctors who are unwilling to provide an opinion

    relatives of mine have a son - brother who was for a ( very brief ) time in the psychiatric services although he was never detained in an institution , as such the familys GP has steadfastly refused to sign off on whether the chap is competant enough to understand a legal change to a property deed that the his mother and brother are trying to instigate via the family solicitor , my aunt became a widow quite young and her husband didnt make a will , therefore my aunts son ( my cousin ) who is not altogether well , is in his own way , involved in any legal transactions that would need to be made regarding assetts etc , my aunt , my cousin and the family solicitor have asked both the family GP and the local consultant psychiatricst to provide opinion on whether thier son - brother is competant enough to agree to any changes re _ property deeds etc , the local GP kicked to touch and insisted that because thier son - brother had been a patient of the psychiatric services , that it was up to them ( and them only ) to deem thier son - brother competant , where as the consultant psychiatricst has stated that because this young man has not been a patient of the psychiatric services for more than a year , the issue no longer falls under her authority , now i realise that many GP,s and consultants love nothing more than to sit thier nice well paid arses up on a nice comfortable fence when it comes to ( relativley ) unconventional issues like this but surely my relatives have some recourse here , thier intentions regarding thier son - brother are entirely honorable , in fact , they want to set up a trust for thier son - brother with a sizeable percentage of the family assetts going to fund it , unfortunatley , nothing can be done untill a medical professional deems thier son - brother mentally competant to understand any legal changes to the relevant legal documents etc

    my question is , can my relatives and thier solicitor keep searching for a doctor who is willing to offer opinion or can they force thier local GP or consultant to examine thier brother - son , bear in mind that on every occasion that my aunt has tried to have her son detained against his will , the psychiatricst in question has insisted that the mans problems are not not psychiatric


    all advice welcome and appreciated

    You could tryto be a little more polite to the people you want to provide you/your brother with a professional service.

    To answer your question, neither the GP nor the psychiatrist are obliged to make a determination that they feel they are professionally unable to make. Although, it would be surprising that the psychiatrist is unable to do so merely because he hasnt seeen the patient in a year, particularly if he is given the opportunity to to a detailed asssessment now.

    2nd (or 3rd) opinion, perhaps?

    This guy spends his time on boards being utterly obnoxious about doctors, so it's no surprise he's had a little dig. And now he wants advice on his own personal situation. Barge pole etc.

    its my cousin and i would not or will not be making contact with any GP or consultant , how could i , im merley relaying the details of the story , my relatives wish to make pretty standard ammendments to a property deed and also wish to put in place provission for thier son - brother who is perhaps what you would call special needs , due to the fact that the owner of thier assetts did not make a will , all family members are required to give thier approoval to any changes that are made regarding the relevant assetts in question , no solicitor can proceed unless a medical doctor deems one of the family competant to understand such ammendements

    all i was looking to know was whether thier were any other options worth exploring , for instance , could the family and family solicitor seek the opinion of a doctor living in the next town over or would they inevitabley send the family back to thier local GP , it seems a shame that all plans have to be scrapped just because a few doctors cant be bothered doing a simple favour

    its people like you who further reinforce the stereotype about doctors being , arrogant , aloof , condescending and dismissive , i dont know which posts you are refering to but the only doctor ive had any criticism of in boards is a mod named SAM , anytime i raised an issue relating to the familys of those who suffer from mental illness , this particular individual has given me the back of her hand and repeatedley dismissed my concerns for my close relatives as being nothing more than the rantings of some malcontent , perhaps you might someday realise that lay people are not always wrong just because they are missing a few letters after thier name

    the only thing funny here is your ultra sensitivity to comments even remotely critical of your chosen profession , i rarely ever post in any of the medical forums , politics , soccer , films , im a regular in , yet you obviously have me on some form of a list of people who dare to question certain medical practices , thier are entire threads devoted to issues of teachers pay , administration numbers in the HSE - civil service and no one is hardly ever singled out for having the audacity to raise such issues for debate

    reminds me of an eppisode of the simpsons where ned flanders was going through hundreds of hours of video tape with fine tooth comb , checking for any form of swearing , nudity etc on tv

    dont know how things work in australia but perhaps its time you realised that in the ireland of 2011 , no one is above reproach
