Speeding Ticket Question

    So my wife got a sppeding ticket from one of the new Camera vans for doing 68 in a 60 zone. Fair enough, she has no problem paying the fine. She forgot about it for a couple of weeks due to work travel etc. When she went to pay it was passed the 28 days so the fine had increase to €120. Pain but she payed it. As both our name are on the Registration Document she filled in the section to nominate a driver so they would know who to apply the poionts to.

    2 weeks pass and We think no more of it. I come home from work last friday to find a letter from the Gardai saying that the payment of the fine was rejected due to been passed the 28 day limit for nominating another driver.

    Rang the "Help" line yesterday to be advised that my only options are:
    1. Pay the €120 and I take the points as I my name is the first line of the Registration even though I was not driving.
    2. Leave it go to court and present the Payment refusal and the Registered Owner and the nominated Driver
    Also advised to contact the Vehicle and get the owner details updated. We bought the car new from a main dealer and they filled out the Registration form with both names. Never had an issue before as this is the first time car was caught speed by a camera. I can't find anywhere online that states there can't be 2 owners of the car on the Registration Document.

    So my question is; If this goes to court is there any chance the points will be increased to 4? Do we need a Legal Rep?
    Both of us will have to take the day off work which is a pain.

    Anyone been in a similar situation or heard of one?

    Yes, it will be 4 points.

    I would just suck it up and pay the €120 and take the hit as you will lose more in taking time off of work and attending court.

    depends on the judge in your area, some are fine and will listen to reason , others are complete dictators. If you have a decent one they will listen to reason and as long as you can show you tried to pay in time you might get the benefit of the doubt.

    +1. If its Patwell in Cork or Judge Neilan in Longford they will nail you. I was up before Neilan last year and he told me I was lucky I wasnt going to Jail....:eek:

    It will probably be in Clare or Limerick. Fine was paid on time albeit after the first 28 days. Issue more to do with the way the garrage filled out the registration form with 2 names and the PP system not been compatable with this.

    Ideal outcome at this stage for us would be that the €120 fine is accepted and that the 2 penalty Point are put on the licence of who was driving.

    I may take the hit now to avoid taking time off going to court. Just a pain to get point when you didn't commit the offence.
