Should I return this and what will amazon do?

    I ordered a DVD boxset from an amazon seller called DJ Mikes Shop. It was listed as New, but it arrived unsealed and covered in scratches and fingerprints, really dirty. I emailed the seller to say that I want to return it for a refund. The seller admitted that it wasn't really new (he claimed he listed it as new by mistake) but denied that it had any scratches or marks. He said that I could return it for a refund, but then he implied that I would return a different boxset to the one he sent me, and said that if I do so he will involve the police!

    Now I fear that if I do return the item, he will pretend that it's not the one he sent me and will refuse to refund. Because he is clearly untrustworthy, I have left him negative feedback (he has 16% negative!) and filed an amazon claim. I explained all of the above in the claim.

    So, should I still return the item? And what will amazon do? Should I wait to see what they say before I return it? What do you think the likely outcome is?

    Report him to Amazon. They are very protective of their reputation and will not accept any shoddiness. They are pretty good themselves with giving refunds, so its fair to assume they would expect third party sellers to do likewise.

    I've filed a claim.

    He's now written back saying that he wasn't threatening me and that there's nothing wrong with the disks, but if I return them he will refund me after he's checked them.


    I have answered:
    If you are still claiming that the disks were not marked in any way then how can I trust you? You have already admitted that you falsely claimed that the item was new, and now you're accusing me of lying, saying that the disks weren't marked when they clearly are. Why would I go to the hassle of ordering something online and then sending it back, if there's nothing wrong with it? For all I know, you might "check" the product when it is returned and tell more lies, inventing a reason not to refund me. You have 16% negative feedback and other people in your feedback claim that you've sent them defective items or that they are still awaiting refunds.


    I'm worried that that will make it sound like I am the one being difficult, but seriously I don't trust him!

    I've just realised that my claim isn't showing up and it says you can't file one until 30 days has passed. I guess I'm just going to have to post it back and hope he refunds me.

    If he doesn't refund you after you have sent them back, then you can still pursue Amazon for the refund anyway.
