abandoned house

    not sure if this the right place for advice.i left my husband 2 years ago and he remained in the home,he would'nt leave so we did. now he tells me he has moved out of the house because it has burst pipes.so effectively its sitting abandoned.i've been out to it and its a mess.kids do'nt want to move back there and they've settled now where we are anyway.the situation is a mess and i do'nt know what to do.has anyone had a similar experience and if so how did it turn out? thanks.

    Why not sell it if you don't want anything to do with the property anymore? If your former partner does not want to sell the asset and you intend not to reconcile the sale of the property could form part of your separation, whether the separation is by agreement or court order.

    What exactly are you asking?

    You basically said you have a house with nobody in it and you are telling use to give you a legal opinion on it?

    would be happy to sell it,whether it'd sell or not is another days work.in the meantime though the bank will still want their money,plus i have the expense of clearing up his mess which he wo'nt contribute to.

    Why not refurbish it and move back in?

    Ok, so your question relates (i) to your position with the banks and (ii) to who would incur the expense of cleaning it up. Well the banks will want their money back if there is a mortgage over the property so that is something you will have to deal with. There is no reason why you should have to clear up the property yourself assuming (a) that you own the property jointly and/or (b) that he remained in the property under the assumption that he was to maintain it.

    I suggest that you attend at a Free Legal Advice Centre (FLAC) where they will be able to go through the issues that you raise alot more thoroughly and point you in the direction of other bodies which may be able to help you in terms of progressing all the issues at hand and their relationship with each other.     It will have to be repaired as otherwise the damage will probably progress further. Would house insurance cover any of the damage? Maybe you could refurnish and rent it out.
