Insurance claim gone wrong due to me posting on boards.ie

    Hi,
    I have a slight problem with an insurance claim and was wondering if you could give me some advice.

    I purchased lifeline phone insurance with the Carphone warehouse in January. At the start of February I submitted a querie on the popular website boards.ie. I was trying to figure out if it would be worth my while continuing to pay for the insurance as they no longer stocked my phone. I told the members of the site (nothing to do with insurance company or carphone warehouse) that I lost my phone and asking what phone do they think I will be given as a replacement, to see if I should continue to pay for insurance.

    When I actually did loose my phone on Feb 24th my claim was accepted and I was offered a choice of 2 phones, none of which I believed matched up to my phone. After complaining (to the insurance company and also asking for advice on the boards.ie website) I was offered my original phone and I accepted it and I was told that it could be collected on Monday match 7th in-store. I then received an email on the 4th of March saying that my claim was now rejected as they seen my posts on the boards.ie website and believe that the phone was lost since then (must be reported within 48 hours)even though I explained to them what actually happened?

    Can my claim be rejected due to something that I said online (where I had no obligation to be truthful)?
    They also threatened to have me charged with fraud!!

    Because I was the only one who claimed for a Samsung wave and complaining about the problem I was having with them offering me ****ty phones. So they seen my post when complaining and must have looked at my history to find the old post.

    I had a claim with carphone insurance before.

    The phone would not charge and was sent away for a few weeks. After picking up the phone, and getting home a few hours later, I plugged the phone in and the exact same problem existed - it would not charge. I phoned them and said the problem was not fixed to which the customer service representative said "It was fixed, our engineer signed off on it, you must have damaged it on the way home".

    Flucking scumbags, I've never dealt with them since.

    Did you ever get it sorted out, meteors CPP insurance is just as bad, Im going to avoid phone insurance altogether now.

    There'll be a noticable gap in your phone records from the time you lost your phone unless you don't often use it. This should provide a level of proof that your phone was lost on or around a specific date. This is probably on your bill. Inform your provider and/or insurer of that fact and see where it goes. Let the insurer know that the allegation of fraud is a serious matter and should not be made with adequate proof and that you are very unhappy about this.

    There is no gap (nor did I ask for a replacement sim) until I actually lost it.

    It all completely stops when I actually loose the phone. They claim it was lost on Feb 6th

    This is surely a trolling thread.

    1. If you didnt actually lose your phone at the start of Feb, you would have made a load of phone calls between then and Feb 24, when you really did lose your phone.
    2. They are refusing your claim on the basis that they think the Boards username 'dillo2k10' is you solely on the basis that dillo2k10 has had a similar set of circumstances to yourself; and you accepted that?:confused:

    Surely you have the good sense to simply point them to your account, to all of the phone calls you made in that period, explain the purpose of your posts on boards (if you wish) and tell them that if they are making an allegation of criminal activity against you, you will take action against them.

    This story sounds ridiculously fishy; or else, you need to learn to stand up for yourself.

    Your only hope is to get them to prove it was you and since you again just admit on a public forum read by millions that you are in fact... yourself while this is happening and even included dates you filed the request... I reckon you don't have a leg to stand on.

    No, as the nearest carphone warehouse was an hour and a half drive away at the time. I did not have a car and had to sit on a bus to pick it up. I just cancelled the insurance and went back to using an old phone I had. I wrote a letter to customer services but heard nothing back.

    I just thought the attitude of the guy on the phone was really nasty. And there was obviously incompetence (or worse) giving me back a phone that was not working, and then claiming it had been fixed.

    I can assure you I aint no troll.

    When they asked I admitted that I posted as I was not expecting and I actually thought it was about me complaining about the ****ty phones they were offering

    I did of course make a lot of calls but they say it could have been used in any phone, I tried to point it out to them this was when the person on the phone started sounding rather annoyed and threatened me with fraud

    I had already admitted on the phone that I was the person who posted on boards, as I said I only said that to get a response, I know that it was my own fault but I am first trying to see if there is anything that I can do about it. I shouldn't have said it but I did, I did report it missing to the Gardai aswel as meteor on the 24th when I actually lost it.

    So what are they claiming you did?
    - Took the sim out on 6 Feb, and then lost the phone?
    - Or that you are trying to defraud them in which case why wouldnt you have simply made the claim on 7/8 Feb rather than waiting until now?

    Did the phone have GPS? Would its whereabouts between 6 - 24 Feb not be traceable.

    All a bit bizarre; if true, you nee to get these guys to put on paper the precise reason they are refusing your claim.

    I am not doing anything illegal, so no way to incriminate myself, the problem is that I lied on boards.ie (which im pretty sure is not illegal)

    Do the terms and conditions of using boards prohibit commerical activity ? If so could the fact that Carphone warehouse are using to boards to carry out commerical activity prevent them from using the posters data/comments?

    You should also force Carphone warehouse to prove that it was you posting (could have been someone using your pc).

    Couldn't they find out if your 'lost' phone was or wasn't used to make calls at the various times by the phones unique IMEI number in their own logs?

    Does anyone know if they actually log IMEI numbers?

    I think that I have my proof sorted out. I just got of the phone with o2 (as I was using the phone for a day on the 15th of Feb with them) and they are sending carphone warehouse confirmation that the handset in question was used to make calls on the 15th of Feb and so could not be missing since Feb 6th

    Doesn't the IMEI code of the phone transmit every time the phone is used; telephone operators can, in the case of stolen phones, stop the phone from being used through these codes.

    The operator should be able to tell if the phone you claim to have lost was used between the 6th and 24th of February based on this.

    I know, but I still don't think that it is good enough proof.

    It wasnt even me that wrote it sure, this is my sons account who was trying to find it out for me, but I admitted it was me. Im using his account now.
