is it legal to get a mate to post tobacco from spain/other EU country?

    Got a mate living in spain at the minute, reckon he could send me some golden virgina pouches in the post. This previous thread says there is actually no limit to how much tobacco/alcohol you bring back with you since by EU law duty has been paid on it already. I presume there is some limit to how much you can post though, anybody got anything concrete? thanks

    afaik you have to bring it back with you in person, if you post you are liable for tax to be paid.

    It's so very expensive here. There is a legal minimum price which stifles competition, a law which the EU has called illegal. I reckon I am well justified in looking for a cheaper way to buy it.

    I need specifics. I am not buying directly from a business in another country - someone else has bought it in the country and then sent it to me. Sounds like a nuance, but I trade records and you don't have to pay duty on items that are second hand as the duty is considered to be paid by the purchaser. What if a friend in spain wanted to send me a present of a bottle of wine, or a bottle of Jameson? What if instead I was a pipe smoker and he sent me some fancy tobacco? I thought presents could be sent duty free.

    I think there is an issue with that tax on smokes in Spain are less than in Ireland and therefore Irish Customs will stop the shipment until you paid the added tax here.

    I was not sure whether to move this to Smoking or here but I think that this forum will be more inclined to answer with legal specifics.

    Ask around a bit and look at some local car boot sales. You can find cheaper cigarettes from Eastern Europe fairly easy now because no one is prepared to pay the extortionate prices in the shop.

    I haven't come across counterfeit ones yet (after 8 years) despite RTE's best efforts with their primetime "expose" on the cigarette industry.
