Looking for a case name

    I'm trying to find a case and I'm a bit hazy on the details which is probably why I cannot find it or think of the name.

    Essentially you have a Solicitor that hires another solicitor (think it's his firm but cannot be certain of this) that is attempting to purchase lands (sell them?) to another person. Contracts are entered into through Solicitors on behalf of both parties.

    Anyway things are ok until the Solicitor who is purchasing the land starts varying the contract with the vendor directly (not via the vendor's solicitors) and it all goes south and Solicitor brings Specific Performance claim.


    Name is totally escaping me. I may be confusing 2 cases... help is appreciated :D

    Could you be mixing up AIB v Maguire, decision of Peart in 2009 with another case?

    The one I was thinking of was Ó SIODHACHÁIN & ANOR v O'MAHONY & ANOR ... I was not fully correct on the facts and I think I may have been adding in bits of AIB v Maguire :D
