Copyright of graphics

    Could anyone offer some advice?
I have created a set of images/graphics for a client in October 2010.
    Invoiced the client in November.
I received 50% of the fee but am still awaiting the remainder.
None of the work (images/graphics) have been release to the client yet (it was made clear to them that the work would only be released once final payment is received).
We may be able to sell these (images/graphics) on to media organizations etc and recover at least some of the remaining fee.

Can I (under copyright law) sell these images/graphics on to a third party (since the original client hasn't paid for them in full), or am I opening ourselves myself up to a lawsuit against me?
Or would I be entitled to sell the work on to a third party only if I returned the fee received to date?
