New Dual Mandate TD's

    Could anyone clarify the position regarding local councillors who have been elected as TD's in GE2011?

    Presumably they will have to resign their local government seats and forgo any retirement pensions etc. in order to take up their seats in the Dáil?

    Will there be by elections to town/city/county councils to fill their positions?

    No election required - the outgoing candidates will co-opt new people to take over the council seat.

    What about Alan Kelly in Tipperary?He was elected to the European Parliament in 2009 and presumably will now have to give that seat up.Who if anyone will replace him there?

    Same setup - the Labour party will just replace Alan's seat. Same goes for Joe Higgins.

    That's just wrong on so many levels, isn't it?
    If there was a list system that would be acceoptable but not this co-opting lark (I know it's not any one parties policy/fault, it's the system again)

    MEP Replacement Lists
    In Ireland, there are no bye-elections to the European Parliament. If an MEP resigns from office or dies during his or her mandate, the vacancy is filled from a replacement list, which is presented by parties or independent candidates to the returning officer in their constituency prior to each European election.

    Joe Higgins list:
    Socialist Party
    1. DALY, CLARE
    2. COPPINGER, RUTH
    3. MURPHY, MICK
    4. KEANE, DENIS
    5. MURPHY, PAUL
    I got this from Googling MEP replacement. It is slighly different from Council in that you submit your list in advance. I agree it is rediculous. I dont mind a County councillor being replaced - but Ruth Coppinger MEP?? I voted for Joe Higgins and was proud to have him as an MEP but someone from that list?

    Didn't know that - are the elctorate presented with this list before voting?
    Looks like Ruth Coppinger is going to Europe.

    I know FF publish their MEP substitute list with literature at the time so I assume all parties have to do that.

    The replacement system is used throughout Europe as there are no by-elections to the European Parliament. This is one of the features of the list system.

    I'm rather unimpressed with Alan Kenny's running for TD after being an MEP. Seems like he was just using the MEP election to build a profile for himself. Poor form, I think.

    Welcome to the reality that is politics, not just Fianna Fail that uses the system to their own advantage ya know.

    Joe publicly stated that he would contest the General Election and take up the Dáil seat if he won during the European Election campaign.

    That's exactly what he did.
    Joe Higgins made no secret that he'd run for the Dáil, Alan Kelly became an MEP to increase his profile

    If he was committed to Tipp North he would have resigned and then ran for the Dáil.
    But no, he kept a backup plan and if he lost he'd be straight back to Brussels
