Last Minute Legislation for the ISPs

    In the last 48 hours of this utterly unethical government, the last act of cowardice and vandalism is the leashing of the ISP's to big businesses private concerns.

    If this is passed, we will end up with ISP's simply retracting from the state for fear of suit and ultimately a hobbled internet in Ireland.


    We need to stop this but I don't know how.

    WTF they have a mandate again? When they were supposed to put 10 billion more into the Banks last week they said they didn't have a mandate and kicked the can down the road for the next government to take the flak. Then this week the mandate has reappeared again and are going to rush through legislation that could have serious consequences for business and private use of the internet a vital medium and tool for the world of today.

    Tom you need to scream blue bloody murder in every medium you can find starting here with boards.

    What a pathetic bunch of halfwits our outgoing government are. If anyone is seriously considering voting for FF they really should reconsider after this short sighted and rushed decision.

    The last act of a party deeply indebt needing funding for an election campaign that it was inevitable they were going to lose in my opinion.

    No way they didn't get a little something for this again in my opinion.

    So true, they have 'no mandate' when it suits them, but the mandate returns again when it suits them.

    so what other option is available then? I use torrents for my dls on me mac, I used to use a p2p but that's windows only :(

    I fired an email off to my two local FG candidates asking them to confirm that they will revoke this if enacted once they enter Government and that I would like their response before I vote on Friday.

    I suggest that anyone else who feels this is an issue does the same.

    Emails sent to FG, Labour and certain independent candidates who may be brokering an agreement with FG.
    Also SF and Socialist Party candidates as these will at least kick up a storm of shít about this in the Dail.

    I dont understand why the Music Industry don't just make their own ISP companies and regulate themselves. They have enough money to make it happen. I've had a look and surprisingly none of their parent conglomerates appear to have any toes in the Internet Service Industry.

    It mentioned that this was being effected by a statutory instrument. This might suggest that it could be enacted at the minister's convinience depending on its commencement section, and hopefully with the change of government this will be never.

    The judge highlighted the deficiency in Irish law which resulted in Ireland currently having no mechanisms to forcibly disconnect internet users who engage in illegal downloading and commented that this results in Ireland breaching its obligations under European Union legislation

    Irrespective of whether a current or future minister deals with the issue some legislation has to be brought in. FG will also have to bring it in to. Blanket refusal to bring it in isn't realistic.

    Thats the thing the use of the word "criminal" is very wrong when its a civil mater,
    the courts have enough things on their hands than to be chasing 10 year old kids criminals for downloading latest pop trash.

    Next you'll be trotting out the line "it's a gateway activity" ...

    In any case, it's civil law they are breaking, not criminal - not to excuse it of course, but there is an incredibly important distinction to be made. And the RIAAfia have done very well to fudge that rather pertinent little fact in coersing (i.e. lying through their f*cking teeth and playing Al Capone accountant-esque hocus pocus with their reported sales drops) governments into doing their dirty work for them.

    Nah, I'd say the Internet stirred this one out of all proportion.

    I don't think FF would be that quick copping onto it going on recent history.

    Honestly, I thought it was a really weird thing to bring in on the eve of an election. The last thing FF need is to bring in legislation that will cost them even more votes and/or preferences.

    Similar to the 5 new channels for RTE, she may have thought it would go unnoticed on the eve of an election.
    One main reason this is wrong is, apart from the obvious folding to a big business lobby, illegal downloading and access to internet use are completely separate things.
    If you rob a bank you're not banned from holding a bank account. It's the big companies trying to circumvent laws for their favour.

    I've posted this since 1998.......we will see laptop/desktop licences similar to the TV at some point:(
