JSB after quiting job?

    Hello Everybody,

    Just looking for some info on my case. Basically I am a lorry driver and I was working with my employer for 18months but during my time I was being pressured into driving over my legal hours.. I had several fights with my boss over this and essentially he made my work so awkward that I had to quit.

    I quit on the last week of October 2010 but I didnt sign on until the start of February 2011 as I thought I would get a new job fairly soon. I explained to the Social about my working conditions about being bullied into driving over my hours etc but I said to Social that I was let go (which is technically not true)..

    I rang to see how my claim was coming on and the Social said they sent a letter to my previous employer (to see what his side of the story is I think).. What are the possible outcomes of this situation as I am sure my employer will tell them I quit??

    Any help or info would be great.. Thanks

    If you quit you may have to wait up to nine weeks before you can claim.
    And you served this, from October to February.

    There are ways to claim immediately like if you have doctors letters about stress but that doesn't apply here

    So they didn't need to know this story at all. Should have said nothing
    And I don't see why they are delaying your claim over this.

    If you're entitled to JSB and the nine weeks are past you should be approved

    Oh I see. I can guarantee my previous employer will tell I quit along with "How bad an employee I was" .. So if they found out I quit will I have to serve another 9 weeks from when I signed on in February??

    I have been to my solicitor over this matter but we didn't pursue a case against my working conditions. The company still owes me money??

    No, you've served your nine weeks so you are entitled from February and the day you went in

    Your legal case and all that is separate from welfare, they don't need to know any of this for your JSB claim

    Cheers for your help.. Yeh I know the legal case is separate but they asked did I do anything about it?? My employer wouldnt give me my last 2 weeks wages, after a series of legal letters I managed to get most of it but not all.. I told social this.

    When I rang today to see what as going on they said they were waiting to hear back from employer. She said it will depends on what they reply back with and I may have to wait 9 weeks until April??

    I never signed on before so I didnt have a clue what she was on about and she just hung up??

    Don't worry, your claim will be backdated to the correct date.

    Just it's going to be delayed over this.

    I do think you said too much but you know for future :)

    Your employer may not send back the form so you should keep on top of this with your sw office in the meantime go to your community welfare officer and apply for supplementary welfare allowance. As stated already you have served your nine weeks disqualification period.

    Hello everybody again !

    Just a question regarding my claim. Its been a few weeks since I updated this post. I have been ringing the SW Office the last 4/5 weeks to see how my claim is coming along. But basically now the SW are waiting for my previous employer to reply to there letter regarding how I left my job.

    Its fairly obvious my old employer are not responding to the SW letters most probably to delay my claim, but everytime I ring the SW they say they are waiting for a response. Is there anything I can do?? If I called into the SW in person would they take a closer look?? I started my claim on the 2nd feb '11

    Any info or help would be great.

    this is now very complicated, mostly by the fact that you didnt give SW the full facts when you made your claim. the easiest thing in the long run is to be completely up-front from the very start when making a social welfare claim. even if your former employer does now respond to SW requests its likely that he is going to tell them that you left of your own volition, which is what you did. this flags you up as being, at best, economical with the truth. as another poster has pointed out you will probably be deemed to have served your nine weeks penalty, this means that you will not get a back payment for the first nine weeks after you left work but will be back paid for any weeks since that elapsed. did you not apply to the CWO for SWA?

    No Mrs Byrne I didnt. I have been living of my savings. From what I gather from ringing the SW I think they have sent 2 letters to my old employer with no response but they are still waiting for a reply?? What if my old employer dosent reply at all??
