Withholding bonus payment

    Hi

    My company pays its annual bonus at the end of March every year for the previous year.

    eg. the bonus for work done and targets achieved in 2010 is to be payed at the end of March 2011.

    However if the employee leaves the company in Feb. 2011 the company refuses to payout the 2010 bonus, even though the work has been done.

    Does anybody know if this is legal or can the employee challange it ??

    Most likely says that the employes must be employed on the date the bonus is paid to recieve it.
    A person could fight it to get a payment on pro rata basis,has been done where i work but it was concerning temporary layoffs who would be called back.

    No unfortunately, there is no contractual obligation for an employer to pay a bonus unless it is specifically provided for in your employment contract. It is at their discretion and they can put whatever proviso they so wish on it. Your best option is to talk to your employer to see if they can facilitate you in some way, but from a strictly legal stand point they are not obliged to


    So it doesn't look good..............
