Incorrect spelling of name on Summons

    A friend got a summons for speeding, but his name is not correctly spelt, How does this affect the summons? (and yes he shouldn't have been speeding, just asking a question!)

    He could get the case thrown out if he gets the Grammar Nazis to represent him in court.

    Your question mark should have been after the word 'summons' and not after 'spelt'. I am being a grammar Nazi I know.

    On another note, I doubt the name misspelling would affect much.

    He could get the case thrown out if he gets the Grammar Nazis to represent him in court.

    The summons wasn't addressed to him, none of his business.

    They will correct the mistake while you stand there all smug thinking that you will get away with it.
    Next thing when the correction is made by the clerk of the court, the case continues with the correct name and amendment made.
    I've seen it happen while I was in court for a tax offence a few years ago. It was funny to watch.

    Exactly. Your friend should prepare as if everything is correct. This will be corrected by the clerk on the day, and the case will be heard. It won't be thrown out at all.

    If he gets legal representation, he may be able to get off. On the same day in Nass court, I saw 2 separate similar cases. One had a legal eagle and was struck off, the other guy gave evidence against himself, and was prosecuted. that was about 10 years ago.

    i seen it happen in naas court too, that judge didnt seem to take too kindly to silly mistakes made by the guards

    It happened to me a while back (unusual first name) and the Garda pointed it out at the start, the clerk corrected it and the case continued as normal.

    Both offences still ending up getting thrown out anyway, thanks Judge :D

    It's in the District Court Rules, the judge can make minor amendments to the summons if it doesn't materially affect the charge. Obviously he couldn't change the charge from careless to dangerous driving but correcting a spelling mistake would easily fall into the 'minor' amendment category.

    He got the summons delivered to him,should it be wrong address or date etc he would get away with it.

    Same happened to me. Name's Neil but the summons said Niall.

    When called upon by the judge I informed him of the incorrect name and they just amended it there and we carried on.
