Advice needed! Mortgage payments missed during seperation

just looking for advice - my partner and I are trying to get a mortgage, BOI will give it to us but won't give us enough and EBS just came back saying they would not give it to us as my partner is divorced and when he moved out of the family home, a court order was put in place to say he would pay maintainance and it was his ex wifes responsibility for paying the mortgage. He did not take his name off the mortgage at the time as he really was all over the place. His ex wife did not pay the mortgage for 9 to 12 months. She now has bought a house herself after they sold the marital home. We have letters from solicitors stating he was not responsible for the mortgage, but EBS are refusing us a mortgage based on this - They were lovely to deal with to be fair, but said they cannot do any more. Im just wondering if we can do anything or if we have anything legally to stand on?
    thanks
