Oil Company filled tank with more than I want

    What do people make of this conundrum, I requested a few hundred litres of oil, got a quote and arranged delivery. Dont want more than I need (i rent currently and may not be there next year, and not keen on overspending in these difficult times).

    So the guy arrives, then says he accidentally put more than 200 litres extra into the tank, and wants me to pay for it all. I say no, I'm only paying for what i ordered, and he can take it back if he wants. He says he cant, and says the office will get back to me. So a few days later I get a call from the office saying that i have to pay for it, and that they may be able to give a discount (€20!).
    ???

    Tricky one. I'd stand my ground and not pay it. Their mistake, their loss. Dunno about the legal implications though.

    same thing happened to my brother and they offered to take it back but may depend on how much oil was in it but they shouyld have counter on truck to tell how much they have put in. the oil company said they would take it back or he could make payment plan sorta thing with them if he wanted to keep it.

    No way would I pay.

    why pay for their mistake?

    I would explain what you just said here and tell them they can have it back. Maybe put it in writing and send it to them, asking them for a written response. I certainly would not lose sleep over it.

    Why would you pay? Furthermore as the machine does not have the capacity to measure the amount of oil it sucks out you cannot allow them take it back because you do not know how much they will take.

    You tell them that you did not order it so you do not want it and unless they can accuratly measure the amount they are removing you will not be allowing them touch it.

    Tell them they are free to take it back once they can prove they are only taking the extra they oversupplied.

    Then finish by explaining that it was there over supply mistake you have no problem with them taking it back but will need them to prove it or you will be sueing them for theft.

    I am sure someone in consumer affairs can confirm why this is the case.

    Its all more common these days. Do not pay whatever you do. The likelyhood is they might not even come to take it out.

    When I moved out I ordered oil with the company my dad uses - to my new address, different from my fathers address, having the same surname (like alot of people do) this company somehow messed up and delivered 500L to my father instead of me. He didn't want it/need it. They offered him £13 discount to keep it. He told them to come take it back if they wanted. They never arrived. Few months later I ordered oil again - same thing happened and they never came to pump it out. 3rd time I ordered same thing happened - this time they did come and pump it out and forgot about the other 2 times. We both went to separate companies after this - idiots! It cost them more than £13 to pump it out I tell ya that!

    Also I remember oil man put 500L into my GFs mothers tank by mistake - he was meant to deliver to the park but delivered to the drive (her house). Random man called one night with pump to take it out.. GF was in the house on her own and let them - I'm not quiet sure I would have. Their mistake, lock the gate and tell them where to go or come back with a court order or something. I don't find a measuring stick to tell you how much is taken back out accurate enough to make me happy about it. They wouldnt give u more than you need for free so why should you let them poss take slightly more than whats theres back out?
