Question about HGV trailers left parked on the hard shoulder

I've observed on the South Ring in Cork after the Sarsfield R/A heading west how HGV trailers & containers -sans driver and cab- are parked on the H/S immediately after the R/A and seemingly left there. For collection or what i'm not sure.

I've noticed that this is a common enough occurence around these parts, you'll see similar just after Cork Airport on the R600 for instance, but is it legal for these to be be parked on what is important routes like the N25 which should surely be left free at all times and thus in violation of the ROTR? or am i just nitpicking and actions like this are allowed?

It's probably allowed. The South ring, although it is essentially a motorway with it's 120km/h speed limit, is classified as a HQDC (High quality dual carriageway). On a motorway this would certainly be illegal, but without motorway restrictions I don't think it is - I'm open to correction here of course. How close they are to the roundabout might be a factor though, if it's obstructing or makes the roundabout more dangerous there may be some rules against it.

It is not allowed at all. Stopping or driving on the hard shoulder is only to be done in an emergency such as if a truck or car breaks down or has a blow out or loss of brakes etc and needs to pull off the road. Anything parked on the hard shoulder is going to cause an even greater hazard.

It is not allowed at all.

As per which piece of legislation?

The road traffic act or some other such act. Try using Google to search instead of relying on others to provide you with the answers. Lay-bys are the proper place for these cowboy truckers to park their empty trailers.

Edit; op and 2nd poster are correct that this parking us allowed or at least legal on any road apart from a motorway hard shoulder. But only where it dies not impact on the normal traffic flow or force pedestrians out into the traffic. So if there is room for it then it is allowed.

Call the local Garda station - the country could use the fine revenue. (If Pretendeville still had a job I'd make him the next call if the Guards didn't act - I'm sure he could leverage some kind of scare angle)

The general belief is that parking on hard shoulders other than on motorways is not illegal. You believe that it is, so the onus is rather on you to show some evidence for your contention, Saying that "It is not allowed at all" is pretty definite, back up your statement as you are one out of step with everyone else.

The area where the OP is talking about is only a 100KPH zone. They do be parked near enough the roundabout though.

I still think it is dangerous though leaving them there. However I have seen the on the N72 at roskeen and the trailer is dropped facing the traffic so no reflective markings can be seen. Also if you were to hit it you would hit the landing legs

    *Ouch*.

Did they have parking lights on ?

Aren't most of the hard shoulders on DCs in Cork marked as clearways? Solid yellow line like. If so, call the guards. If not, unfortunately they're not likely to be breaking a law despite being a serious safety hazard both while static and when being picked up.

The only people to worry about hitting parked trailers are the idiots that drive on the hard shoulders.

No they would not because they have no truck attached to them..

wouldn't they require illumination at night ?

    1. slap a "For Sale" sign on them
    2. (this step may not be legal)
    3. Profit ! :pac:

What about people driving in the correct driving lane while someone is pissing around reconnecting the trailer to their tractor unit?

The correct driving lane would not be the hard shoulder though. It is still a dangerous practice IMO.

Someone working on attaching a trailer is not going to be standing in the H/S for about half the time. They'll be in Lane 1.

Why would they be in lane 1. The landing legs are wound up on the LHS. The driver then climbs on to the catwalk via a step on the LHS to attach the suzies etc. All he needs to do is climb in to the truck.

Surely Garda patrol cars would have seen them already since they seem to be so numerous?
