Ebay dispute, item not delivered in time.

    I ordered a sports jersey from a uk seller.
    I wanted it for the upcoming Superbowl (Feb 6 this weekend)
    I bought the jersey on Jan 18.
    Was in contact with the seller about when it would ship.
    He pointed out that the ad said it would take up to 10 working days to ship.
    No bother, 10 working days means it would ship Feb 1 at the latest right?

    Well, after my contacting the seller again early this week, he told me it would infact ship on Monday 31 and he'd send it 1st class priority.
    I didn't contact him after that, just presumed all would be ok.
    But today (Friday Feb 4) the item hasn't arrived.
    So that means i won't get the jersey ahead of the Superbowl.
    I'm so pissed off!

    Anyway, i opened up a Dispute with Paypal and have been in touch with the seller.
    He is saying that he posted the item on Wednesday Feb 2.
    I asked him for a tracking number but he has never provided one.
    Anyway, i pulled him up on the fact that he didn't meet the ad conditions - that the item would post within 10 working days.
    He replied that the shipping date isn't a condition, it's just an "aim".
    Is that true?

    He's offered me a refund but i'd still be out of pocket returing the item to him.
    He hasn't offered to refund me that.
    I explained to him that i wanted the jersey for the SB and now that it won't get here it's almost useless to me.
    Anyway, do i have any options here?

    I thought, what if i just don't sign for the item when it arrives?
    Eventually it will be returned to him and i'll still get my refund right?
    But it would probably take a long time for An Post to go through the trouble of returning to sender.

    Is there anything else i can do?

    When An Post come to delevir it refuse to sign for it.
    It should then be sent back to the seller and as you did not recive it you would get a refund.

    Ok, odds are that i won't be home when delivery is attempted so they'll just leave one of those collection notices.

    I wonder is it safe to assume the return address will be on the parcel?
    I just wonder if this seller is simply ordering stuff from a supplier in asia and gets them to post it to my address.

    I mean, that's possible isn't it? (that the item doesn't have a return address that is much good regarding my getting a refund from the seller?)

    If you get a collection notice and you dont pick it up you will not have recived it not sure what would happen with the parcel if there is no return address on it. But as long as you dont recive the item you should be able to get a refund no probs

    If the tracking shows attempted delivery at your address you will lose a non reciept claim. Attempted delivery (once it doesnt show returned to sender) is accepted as valid proof of delivery by paypal.

    If you recieve it you will not be able to file a non reciept claim, leaving the only option of "significantly not as described". I'd file the claim and escalate it before I sent it back just to make sure.

    Hmm, but i already opened a dispute with Paypal and through the resultant emails the seller has agreed to refund me.
    Isn't that a sort of official agreement?

    So i presume i'm ok to receive the item and send it back (registered post) ?

    No. You would be relying on the seller to refund you. If you didnt escalate the dispute to a claim, and the seller decided not to refund you, he would not be under any obligation (in the eyes of paypal) to refund.

    I'm not sure how to initiate that.
    But anyway, if my team wins on Sunday then i'll be in a better mood and may just accept the item and get over it.
