DIY Divorce/ negative equity /property agreements

    About to apply for a DIY divorce.

    Myself and ex are good friends and everything is amicable, we want to spilt everything 50/50.
    However, and im sure this goes for many people too, we own property which is now in negative equity.
    We'd like to sell but just not at this time.
    We have a verbal agreement that we rent the house/rooms to cover our mortgage, she lives there at present and some lodgers pay my share of the mortgage.

    CAn anyone see any problem with presenting this to the courts ? will we need an agreement in writing of some sort that says the above ?
