dole backdating

    im hoping somebody can help me, i was let go in oct 10 and am actually bringing a personal injury claim against my former employer. I was advised by my solicitor not to claim the dole as it would count against me in any pay out. However my savings are gone and I had to go to the dole office where they tell me i cannot claim from oct 10.Do i have a leg to stand on or do I just have to accept payment from now on??

    hopefully somebody out there has some experience and could advise me. cheers

    Not a leg to stand on pal, you should of signed on when your employment ceased

    You are not entitled to get your dole backdated. It is at the welfare officer's discretion and they can backdate it up to 6 months (or is it 3) unless they changed their procedures in the last 10 years.

    When making your claim (and dealing with the welfare officer, not the know-it-all at reception) you should make this request by giving the officer a letter.
    To whom it may concern.

    I am requesting my jobseeker's benefit payment to be backdated to 1st October 2010.

    I confirm that I was available for work during this time and attach evidence of my efforts in finding employment.

    I did not apply for jobseekers benefit earlier as I was unsure of my entitlement to benefits and I also assumed I would have secured employment by now (personalise this to fit your situation - this line was just my reason for not applying sooner).

    of course, if due to the personal injury you were not available for work you will definitely not be allowed to use this letter.. however you might be eligible to claim illness benefit instead which may also be backdated.
