eBay refund problem

    Hi all,

    I have an ebay issue...

    During the snow, I bought a pair of spikes on ebay at a cost of €33. I wore the spikes for 20 mins on the way to work before they promptly broke to pieces. I was raging and I bought a cheaper, much better pair in town for €25.

    I applied on ebay to refund the product during december to which I received no reply. Eventually, more than 2 weeks later, the seller replied and said it was outside the 14 day return policy. This was unacceptable and (somehow) I took it to eBay and asked them to get the refund approved. The refund was approved and I sent the product back to the seller. I checked the status on the refund a week later and the seller said that he would not issue the refund because he forgot it was outside this 14 day policy. I bought it from a UK seller so Im pretty sure they have a guarantee against this kind of thing under UK law. Its not a whole pile of cash but its out of principal. Im a pretty ruthless individual and I wont be screwed over by anyone easily so now its purely on my to-do list.

    Any tips or tricks to stop this guy from keeping my money would be greatly appreciated. The lovely chap in question is 1-stop-militaria. Just so you can know for your own sakes in the future

    Post split to new thread.

    If the payment was with Paypal, that's where your dispute should be. If it's been more than 60 days since you paid, then it's too late to do anything. If Paypal agree on a refund, they will take the money back, regardless of what the seller's policy is.

    you have the exact same rights as someone who walks into their London stop (Sale of Goods Act, yada yada yada), the 14 day thing is total BS

    surely then they arrived in good condition and broke when you used them? Ergo you broke them.
