Is been Arrested for Drunk Driving a Criminal Offence

    Hi,

    Friend of mine was arrested for drunk driving and she needs to know is that considered a criminal offence ? She's now off the road for a year. All the appliactions for the work she's applying for asks "Have you ever been convicted of a criminal offence in Ireland or elsewhere."

    The question is whether your friend was convicted. Being arrested is not an offence.

    I searched through Citizens Information and been convicted for drink driving is a criminal offence.

    That's not what you asked in your original post, what you asked was...

    And the answer is 'no' but as 234 pointed out, being arrested in itself is not a criminal offence but as you've subsequently discovered, being convicted is.

    Unless she is off the road for a year of her volition, I think it is safe to assume that she was convicted of a drink driving offence.

    The op should fully disclose info if he wants a more accurate opinated answer tho.

    If she was arrested and convicted then yes.

    If arrested and not convicted then no.

    The op did disclose all relevant information, He said his friend was arrested for drunk driving and is now off the road for a year. Any reasonable person would read that as having been convicted of the offence and was punished with a year off the road.

    Boards is not a court and the op was not writing a statement where he would have to go into a lot more detail.
