another speeding summons

    Hi all,
    I know this has been up before but i would like some information on a summons for speeding

    I was stopped for doing 55 in a 50 last june got a warning from the guard and told me i would get a fine and 2 points.

    Now I honestly never recieved the fine(i know thats what everyone says but i honestly didnt) So now i have recieved a summons.

    I was happy to pay the fine and get the points as it is my first ever and its only 80 euro, but now im faced with hiring a solicitor and paying a possible bigger fine. I am trying to contact the garda to try to sort it out but he is in a small station thats only open part time and i dont think i will get talking to him.

    Like every1 else i am feeling the pinch right now and i dont see how this is fair. rather than 80 i am gona be charged 200 for a solicitor and then whatever else.

    Is there anyway this can be sorted? do i need a solicitor? also in the village i was stopped the garda has put the wrong place i was stopped on the summons,

    Any advice please on what i can do?

    And please i dont need any1 saying "dont do the crime if u cant do the time"

    You can go to court yourself and give evidence that you did not receive the fixed fine notice. You will be cross-examined with a view to establishing that you did. If a court considers it doubtful that you got it the summons should be dismissed.

    You could contact the garda in advance of court and explain it to him - if he accepts that you didn't get it, he would usually strike the matter out. There's no reason why he has to accept your position as being truthful though.

    Whether you get a solicitor or not is up to yourself - no more so than in respect of any professional (if you have a leak you can have a go yourself to save the money on a plumber).

    Not only are you liable to a higher fine but you will also have four points on your license as opposed to 2, if convicted in court.

    You'd have to see the summons to offer any view on whether there was any defect on it - that would in any event be legal advice.
