Tax reclaim

    Hi, I know you can only go back 4 years to claim tax credits but if you have been taxed incorrectly for longer, e.g on a pension you never had but got reduced credits because of it can you get this money back for longer than 4 years?

    You can make a repayment claim outside the normal 4 year rule contained in S.865 TCA 1997 if you can show that your claim falls within S.955 TCA 1997. That means showing that you gave Revenue all the correct information and they made a mistake and their figures didn't reflect the facts you gave them.

    This is likely to be a very technical discussion and you will probably need professional assistance.

    Thanks for the reply, basically I noticed on my p21 form that I'm taxes for a pension that I don't or have never received. ( I'm 28). I found an old p21 from 2004 and it is on that too. So I've been over charged since at least then. Will be looking for certs back to when I started working. Will I be able to get all this back? As it I'd nearly 1.5k per year??
    What professional help do you mean? Accountant? Or solicitor? Thank you for the advice.

    A tax consultant - not necessarily either a solicitor or an accountant.

    Thanks. I'll look into getting some professional advice. Do you think it is worth my while chasing this up or will they fob me off with the four year rule? I mean it's my money that was taken wrongly. If I owed them money they can go back as far as they like.

    If it can be demonstrated that you come within the provisions of S.955 they don't have the option to fob you off.

    In general (and I have seen exceptions) Revenue staff don't take things personally. If it can be shown you are entitled to a refund then you will get a refund.

    thanks for your help. im not really sure about it all but i know they messed up on the pension bit of it.
