not turning up for Garda caution

    does anyone know what happens if you don't turn up to get the Garda caution? my brother was told to go into the Garda station in December to receive a caution for being drunk and disorderly, but he never went in, says he forgot :confused:he hasn't heard anything from them but i was saying he could end up being charged in court and that he should go in even at this stage. any idea what happens of you don't go in for the caution?

    The whole idea behind the Adult caution is for those decent people who make the odd mistake to avoid going to court and possibly facing a criminal conviction.

    Part of the requirements for an Adult Caution is the offender must take responsibility for his/her actions and accept the caution. If they do not then they are summonsed to court. My advice for your brother is to contact the District Office in the Garda Station and let them know why he didnt turn up. Only do this if he is keen to avoid going to court and willing to accept the caution.

    Tell him to send a Data Protection Access Request. If he has been cautioned, it will show on this record.

    I know that the Caution is supposed to be accepted in writing but I found out I had received a caution following such a request, even though I had never spoken to any Garda in relation to the so-called offence and had not accepted being guilty.

    If you don't turn up you can/will be summonsed to court. Get him to contact the arresting guard or district office and arrange to come in asap to receive a caution and thats the end of it.

    as said he's been offered the caution for the drunk and disorderly offence.
    its his responsibility to attend, the guards wont chase him up for this.
    if he failed to attend, its likely that a summons will be created for this.

    id say ring the district office monday to try and sort it out, if not expect a summons in 4-5 months time.

    thanks for all the replies, i'll try persuade him to go to the garda station, he seems to think if he ignores it it'll go away, which is stupid
