Buying Part of Neighbours Garden

    Just have a quick question to those that might be in the know.

    I'm currently playing with the idea of extending our house to the side and I was wondering what the process is for purchasing a strip of land from my next door neighbour's front garden. Both houses are old Dublin council houses constructed in the 1940's or so.

    It's not necessary that I'd need this piece of land but the extra 6 feet or so could make all the difference.

    At this stage I've not even mentioned it to the neighbours to see if they'd be interested. Just wanted to get facts in my head first.

    I presume this would have to go through a solicitor and would the council have to rezone the land or anything? Anyone have an idea how much all the legal stuff could cost (apart from the payment to the neighbours)?

    A lot depends on whether your neighbour has a mortgage or not. If there is a mortgage, the lender will have to consent. Your solicitor would have to draw up a deed of transfer, have the property mapped and register you as the new owner of the plot in the Land Registry. Your solicitor could be looking at 1k for this. The neighbours will presumably want their legals covered as well. There may also be issues with the City Council. There are restrictions on the sale of houses purchased through tenant purchase schemes. A lot depends on how long ago the house was bought out and how many owners there have been since.
