Insurance company bullying to get offer accepted.

    Friend of my was involved in car crash just over 2 weeks ago. Girl ran thru red light and into his car - everyone ok - just damage to cars.

    Friend got incontact with her insurance company (FBD) to arrange a hire car while his was being assessed and his claim processed, as he has to get to work in Sligo, but lives in Donegal Town.

    The damage done to his car has been valued at €5200.

    FBD offered him €4250, which he has refused, he was offered €6000 for the car prior to the crash as he was thinking of selling.

    FBD are now taking the little rental car from him, because he has not accepted the claim.

    My question is what options does he have? he has given them a statement from the garage - where he got it serviced - that the car was of UK spec, and in their opinion it was worth that amount, he has shown that cars of lesser spec an higer milage are for sale for more than that in carzone, but they aren't moving.

    He can't afford to buy a new car without the claim money, and can't get to work without a car, so the insurance company have him over a barrel and they know it. Is there anything he can do?

    tell him to arrange his own independent assessor and provide evidence to the insurance company to back up his claim about the value of his vehicle. one letter from one garage isn't going to do this.

    also, what did he tell them it was worth when he took out the policy?

    cars are rapidly going down in value.

    The value you put on the car when you took out the policy or renewed it, is your estimated value, it is not the market value or what the insurer will pay out in the event of a claim. The market value is based on what it woudl cost to replace the car, like for like.

    Given that the car is a UK import, was VRT paid on it?

    You say FBD are willing to pay €4250. What is the salvage worth? That would bring up the amount of cash you recover.

    Yes VRT had been paid
    FBD will own the car when they pay...
    Who pays for the assessor? How can anyone that hasn't seen the car when it was road worthy give a valuation?
    It seems to me from this that FBD could pretty much offer say €3000 an there isn't a dam thing he could do about it... take it to buy a new car an keep your job, or refuse it an have a hell of a struggle travelling over 60 km to work every day, remember this isn't Dublin or the Surburbs.. public transport is very limited. Is there any quick arbritration that can be called in this situation?
