    Hey there, I was just wondering, what is the most common sentence passed in assault causing harm cases?

    If the defendant is a first time offender with no previous history with the guards etc, would this have an impact on the sentence passed? Is it usual for a prison sentence to be given, or is it, like a few people have told me, more usual for a fine to be imposed?

    Any information would be greatly appreciated! Thanks.

    Haha, luckily its not me!! Sibling though, so I'm a bit worried about him. Like I said, we've never had any experience with stuff like this before!

    Oh yeah, his friend got in a fight and when he tried to break it up, the other guy turned on him. My brother threw one punch, but it broke the guy's jaw. Youth today.....

    It depends on the judge and how good your solicitor is.

    The fact that your brother wasn't the instigator of the fight will be in his favour, he needs to get a solicitor to present his case, believe me it will be money well spent but I hope his friend will show up to back up your version of events.

    Broken Jaw is likely to be headed to the Circuit Court for trial on indictment.

    This is extremely serious stuff whether in District Court or Circuit - that is not to say your brother is guilty but on a finding of guilt or plea of guilty there is most certainly potential for a prison sentence.

    He needs a good solicitor urgently.

    Agreed, this could be potentially serious and a good solicitor and barrister will be needed most likely. A lot will come down to who started the fight and most likely medical evidence of how many times the accused hit the alleged victim, etc.

    Realistically the potential sentence may vary from case to case, but this is a SERIOUS matter and should be dealt with promptly by seeking professional advice.
