Ins company notify garda if policy invalid??

    Hey there,

    Not looking for advice/opinions just wasnted to clear up a fact.

    Following an accident the garda take insurance details of vechiles involved.Are the garda required to by law to get the certificates of insurance presented at a station or is the disc on window enough proof?

    If subsequently the insurance company fine they do not cover the vechile/driver etc for whatever reason are the insurance company legally required to inform the garda of such a change?my assumption would be they are so the garda can then check and see if another policy may cover them or if in fact they were driving uninsured?

    Thank you in advance, confused and fed up of insurance companies.:(

    In the event of an accident, the attending Gardai will almost always, 99.99% of the time, direct both drivers to present at their local Garda station and show their licence and insurance details, regardless of what they get at the roadside.

    As far as I know, new regulations have come in which require insurance companies to notify the Gardai when an insurance policy has been cancelled or revoked.

    If it turns out that the person was not covered to drive at the time of the accident, the Gardai may put 2 and 2 together and charge the person with driving without insurance, but unless the other party is attempting to reclaim costs from your insurance company, I can't see any reason why the Gardai would revisit their records.

    I could be wrong though.

    Thanks for your quick reply seamus you dont happen to know when this came into effect or where I could information on this?

    Nope, haven't a clue I'm afraid.

    I just remember a thread here on boards with some guy bitching that his previous insurance company had landed him in it and the Gardai called to his door.

    I also had a look at the Axa car insurance policy and it states that they are obliged to notify the DoT if the policy is cancelled. It's been this way for at least 3/4 years.

    thats great thanks they're being a bit sticky and ive even called to the garda and told them ive been told the policy was invalid but nobody will give me any direction about where to go now other than claim from the uninsured motorists bureau but i think thats wrong unless im sure the other parties uninsured but if its law now surely the garda will have to enquire when the insurance inform them the policy is invalid.
